DMCA Policy

4kClarity respects the intellectual property rights of others. In accordance with the Digital Millennium Copyright Act (“DMCA”), the text of which may be found on the U.S. Copyright Office website at copyright.gov, we will respond expeditiously to notices of alleged copyright infringement that are reported to our Designated Copyright Agent.

1. Reporting Copyright Infringement

If you are a copyright owner or an agent thereof and believe that any content hosted on [suspicious link removed] infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):

 
  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

     
  • Identification of the copyrighted work claimed to have been infringed;

     
  • Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (e.g., the URL of the page);

  • Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and an email address;

  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and

  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. Designated Copyright Agent

3. Counter-Notification

If you receive a notification that your content has been removed due to a copyright complaint, and you believe that the removal was a mistake or a misidentification, you may submit a counter-notification. Your counter-notification must include:

 
  • Your physical or electronic signature;

     
  • Identification of the material that has been removed and the location where it appeared before removal;

     
  • A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification;

     
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located.

4. Repeat Infringer Policy

4kClarity implements a strict policy for repeat infringers. We reserve the right to terminate the accounts or access of users who are found to repeatedly infringe the intellectual property rights of others.
